Fair Use Example:
Library is going to host an election forum for the
upcoming city council election.
The outreach librarian would like to duplicate copies
of a recent editorial in the local paper to be
used as a starting point for a debate among the
candidates. She wants to give each attendee a
copy of the editorial for background information.
Does the librarian have a "fair use" right to copy the material?
First Right Example:
A librarian has a patron who is a small child with dyslexia.
The student struggles to read but loves
to be read to. The library doesn't have much budget for
audio-visuals, so the librarian gets creative
to meet the needs of this patron. She decides to read
all the children's choice book award nominees
onto cassette tapes for this child. According to the law,
these copies would violate the right of the
copyright owner to choose how and when to reproduce
the works.
Second Right Example:
The youth librarian is preparing materials for the summer reading club.
She needs something for the adults as well as the children for the
final celebration. To attract a more sophisticated intellect, she
decides to take one of the Harry Potter books and retell the story
to mimic a popular television detective drama. According to law,
this would violate copyright law because it creates a derivative
work or adaptation.
Fourth Right Example:
During the meeting of the library board, the library director has become frustrated with the children
of the board members who are acting up loudly at the back of the room. She calls in one of the
library pages and asks her to set up a video of a G-rated film for these children. The page opens up
the storytelling room and starts the video. As the word gets around the library, children of several
of the patrons also join in. To keep the attendance to a minimum, the page closes the door. This
showing violates the right of public performance, despite closing the door, because this group is
more than "a family and its immediate circle of friends."
